Carbondale trustees debate comp plan, CMED tonight

CARBONDALE, Colorado - The Board of Trustees will confront two potentially controversial issues at their meeting tonight - passage of a revised comprehensive land use plan and approval for a medical marijuana dispensary center that was once denied a permit to operate.

The meeting is scheduled for 6 p.m. tonight at Town Hall, 511 Colorado Ave., with an hour-long comp plan public hearing set for 7 p.m.

The plan revisions have been in the works for more than a year; the 140-page document updates a plan written up in 2000.

"I hope to approve the comp plan tonight," said Mayor Stacey Bernot.

Also on the agenda is a permit application by Michael Weisser, current owner of the CMED medical marijuana center, 615 Buggy Circle, which has operated at that location since June 2010.

The center predates the town's ordinances regarding medical marijuana, enacted in March 2011, and a moratorium on such business established July 1, 2010.

As a result, town staff ruled that the CMED center was allowed as a nonconforming but permitted use, although it is less than 1,000 feet from the Colorado Rocky Mountain School.

The town's current ordinance bans medical marijuana centers from operating within 1,000 feet of a school's property line.

In October 2012, the trustees denied the CMED application for a permit to operate. They cited concerns that the town's medical marijuana regulations need to be updated and that Carbondale could become a haven for medical marijuana.

In late November, the trustees reversed themselves and agreed informally to approve the CMED application.

At the same time, the trustees imposed a moratorium on new medical marijuana requests as well as on new recreational/retail marijuana shops made legal by the Nov. 6, 2012, passage of Amendment 64.">class="NormalParagraphStyle">
