2013 #2: Murder near Glenwood jolts Roaring Fork Valley

GLENWOOD SPRINGS — The valley’s general sense of calm and peace was rocked on the night of July 31, when a man was shot to death with a pistol and his 18-year-old girlfriend was wounded, allegedly after the girl’s stepfather grew angry over her living arrangement with the boyfriend.

Douglas Menjivar, 21, was shot and killed that night near his home, in a complex of apartments at 1573 Old State Highway 82 (Garfield County Road 154), allegedly by Fredy Argueta Cabrera, 39.

Wounded in the gunfire was 18-year-old Leydy Trejo, the daughter from another marriage of Cabrera’s current wife. The girl had to be airlifted to a hospital in Denver for emergency surgery to repair a bullet hole in her leg.

Witnesses told Garfield County Sheriff’s Office deputies that the shooter had fled the scene immediately following the shooting, and identified him as Cabrera.

By the following day, Cabrera had turned himself in to the Mesa County Sheriff’s Department, who reportedly encountered him at the Mesa County Airport the day after the shooting.

Cabrera has been held without bond due to the nature of the crimes he is charged with — first degree murder.

Over the objections of 9th Judicial District Attorney Sherry Caloia, a judge ruled in late August that Cabrera was eligible for representation by the Colorado Public Defender’s office. The judge concurred that Cabrera was too far in debt to be able to afford a private attorney

But on Dec. 19 two private lawyers, Kathy Goudy of Carbondale and Colleen Scissors of Basalt, signed on to defend Cabrera, for an undisclosed fee, displacing the public defender’s office, lawyers from which refused to discuss the reasons behind Cabrera’s switch in attorneys.

After the swap of attorneys, a scheduled preliminary hearing was vacated and a new one has yet to be scheduled.
