Carbondale man gets 7 years to life in molestation case

GLENWOOD SPRINGS — Gustavo Flores-Rosario, convicted of molesting a child younger than 15, was sentenced on Wednesday to spend anywhere from seven years to the rest of his life behind bars, by District Judge Daniel Petre.

Flores-Rosario, 54, of Carbondale, also was ordered to pay more than $4,300 in fines and court costs, and to undergo psycho-sexual evaluation and treatment, if needed.

A total of $2,300 of the money he must pay the court is for what are called “sex-offender surcharge” and a “special advocate surcharge,” and he also is required to pay $500 for a “crimes against children” fee and $950 as a “sex offender evaluation fee.”

Flores-Rosario also will be registered as a sex offender and required to maintain that listing any time he moves his place of residence, though the judge found that the “defendant does not meet the criteria to qualify as a sexually violent predator,” according to the sentence order filed with the court clerk’s office.

He was originally accused of inappropriately touching two girls over a period of time that started about a decade ago, one of whom was 9 at the time of the incident but was 18 when she informed authorities of the molestation. The other alleged victim was a few years younger but also was said to have been molested when she was about 9 years old.

Of the six charges initially filed against him, Flores-Rosario was convicted of only one charge in a jury trial in November 2013. Each of the six counts was linked to a specifically alleged instance of molestation, but the jury convicted him only on one count involving the older of the two alleged victims.

According to courthouse observers who talked with some of the jurors in the case, the verdict was difficult and “they hated having to do it.”

Now that he has been sentenced, Flores-Rosario has 45 days to file a motion if he has any objections to the conditions attached to the sentence, according to court documents.
