Boulder considers allowing non-citizens on boards

BOULDER, Colo. (AP) ” City council members are considering changing the city charter so legal immigrants can serve on boards and commissions.

The charter effectively bars non-citizens from serving on board and commission because it requires that members be registered voters.

Council members have asked for a proposal to be drafted that would allow non-citizens who are in country legally to serve, interim city attorney Jerry Gordon said Wednesday.



Gordon said he is also researching whether the city can legally allow non-citizens to serve.

Three years ago, council members rejected a proposal to ask voters to remove the registered-voter requirement for board and commission members.



The issue came up again Tuesday as council members discussed several proposed charter changes, including removing a provision that requires all boards and commissions to have both male and female members.

That provision was included in the 1917 charter to help ensure women were given opportunities to serve. Some have questioned whether it now violates federal anti-discrimination laws.

Most councilors said Tuesday it should stay because a legal challenge is likely.

Any charter changes approved by the council would be placed on this fall’s ballot for voter approval.
