Rifle man charged with attempted murder in Christmas Eve fight
A Rifle man was arrested in an alleged domestic violence case and may be charged with attempted murder.
Jacob Vandiver, 21, was arrested early Tuesday morning after allegedly trying to choke his wife during a Christmas Eve fight. The couple has two children, neither of whom was hurt during the incident, according to police.
In a court advisement hearing Wednesday, Magistrate Susan Ryan set Vandiver’s cash bond at $30,000 due to the nature of the potential charges, which includes assault, child abuse, and attempted second-degree murder.
According to a police affidavit, the victim called the police Monday evening saying that her husband was beating her up and threatening to kill her. When police arrived at their home, Vandiver was not there, and his wife was hiding .
She told police that Vandiver had been gone for five hours during the day, and she confronted him about leaving her with their children.
The two had a fight, during which Vandiver allegedly threw his wife against a closet door, punched and choked her, and repeatedly threatened to kill her, according to the affidavit. The victim told police Vandiver jerked her hair, and she said she believed he was trying to break her neck.
The altercation lasted more than an hour, during which the children, a toddler and an infant, were left unattended, according to the victim’s statement to police.
Police said she had visible marks on her neck consistent with choking. An emergency room physician said the injuries were not life threatening, according to the affidavit.
Vandiver was arrested after 1 a.m. Tuesday near the victim’s sister’s house, according to the report. Vandiver denied to police that he tried to choke her and said he did not threaten to kill her.
Defense attorneys requested a bond of less than $5,000 due to Vandiver’s ties to the area and support network. Vandiver has a criminal history, but many of the cases against him, as a juvenile, were dismissed, the public defender said.
Chief Deputy District Attorney Steve Mallory said that some of the cases against Vandiver involved the same victim.
