Developers want out of Carbondale

Crystal River Development filed a petition in district court Tuesday to disconnect its land along Highway 133 from the town of Carbondale.
The petition, filed in Ninth District Court in Glenwood Springs, seeks to deannex 24 acres of land from the town, shifting the boundary to unincorporated Garfield County.
If a judge grants the petition, Carbondale would be cut off from any sales tax revenues generated from a future retail development there.
“I am surprised they did that,” Carbondale Town Councilwoman Susan Darrow said of Crystal River Development. “We would be left out of the sales tax loop, which would be pretty pathetic because we have all the impacts. I would hope the county would be mindful of our needs.”
According to the petition, Crystal River Development manager Brian Huster wants “to disconnect farmland from the town of Carbondale.”
Huster, who manages the company from his office in Del Mar, Calif., did not return a phone call seeking comment on the petition.
Crystal River Development’s proposal to build the 250,000-square-foot Marketplace shopping center was shot down by Carbondale voters on July 15.
State law requires that the property owner must wait six years before allowing development on a disconnected parcel. But the petition states that the owners would refrain from developing the land for six years only if during that time, Carbondale prohibits industrial or commercial uses on adjoining property.
Garfield County attorney Don DeFord noted that a 7-Eleven convenience store stands on the adjoining property.
Crystal River Development also received a demolition permit to raze four vacant structures located on the property.
The permit, pulled Thursday, allows the development company to take down two residential buildings on West Main Street, an upholstery shop behind the 7-Eleven convenience store and a larger building located along Highway 133, Carbondale town planner Bentley Henderson said.
“They’re tearing down some of the buildings down there,” Henderson said. “There are three on West Main and one on 133.”
Crystal River Development hired Wood Doctor Construction of Carbondale to handle the utility disconnections and building demolitions.
The estimated cost of the job is $30,000 and the fees permit and plan check fees are just under $500.
Windows in some of the buildings have already been boarded up, but Henderson said it’s not clear when the demolition will take place.
“They can do it any time,” Henderson said.
