Driver faces vehicular homicide charges after accident near Rifle

RIFLE, Colorado – A man was arrested in the early morning hours of Aug. 8 after a Rifle woman was killed after falling out of the bed of his pickup as it traveled up JQS road.

Eric N. Duarte, 30, faces criminal charges of vehicular homicide, careless driving causing death, driving under the influence of alcohol, and failure to provide proof of insurance, according to the CSP. According to the arrest affidavit Duarte gave a Rifle address as his current residence, but the CSP news releases said he was from Littleton.

According to the arrest affidavit, Rifle resident Audra Kelley, 23, was in the bed of Duarte’s 2008 Toyota Tacoma, when she fell out about 11:34 p.m. on Aug. 7. The report stated that Kelley sustained serious injuries as a result of the fall and died while en route to the hospital.



Kelley was a wife and mother of two.

Four other people in the vehicle were not injured.



According to the CSP news release, the accident occurred between 8 and 12 miles up JQS road on Bureau of Land Management property, that leads up to the top of the Roan Plateau.

Duarte was arrested and booked into the Garfield County Jail, but bonded out on Aug. 8, according to Garfield County Court records. His bail was set at $12,500.

Duarte is due back in court for a return filing of charges in September.
