Judge seals Vail shooting suspect’s jail visitor logs

EAGLE, Colorado – District Attorney Mark Hurlbert said Wednesday it should take the prosecution five days in trial to present its case that Richard “Rossi” Moreau killed a man in a West Vail bar.

“Given the people’s evidence, I think this is less than a two-week trial,” Hurlbert said. “I think with jury selection and everything else, we can be done in five days of testimony. But it really does depend on the defense, what their defense is.”

It will be at least three months before Moreau is even arraigned in the case. A trial would follow. Moreau, 63, of Vail, has been ordered to stand trial for murder in the Nov. 7 shooting death of Gary Bruce Kitching at the Sandbar in West Vail.



Three other people were shot in the incident.

District Court Judge R. Thomas Moorhead ruled Wednesday that prosecutors may not use information from jail logs or obtain the logs from jail officials.



Moreau’s public defenders had moved to seal the logs, saying they would contain information about experts visiting Moreau. Those experts would help Moreau’s lawyers determine if they can pursue certain defenses “involving mental states,” defense lawyers said.

A motions hearing was set for March 29, with another set for May 28. A date for arraignment and a trial date could be set in May.
