Judge unseals court file in murder case

GLENWOOD SPRINGS, Colo. ” Ninth Judicial District Judge Daniel Petre has sided with the Glenwood Springs Post Independent and ruled that the court file for the case involving murder suspect Jesus Hernandez de Jesus be unsealed.

In Wednesday’s hearing, which lasted an hour, Petre ruled the file be unsealed starting Thursday.

Chris Beall, arguing for the newspaper, cited several court cases involving First Amendment rights and decisions.

Tina Fang from the public defender’s office argued that the Post Independent should be held in contempt for a story that appeared on Monday. The story reported responses from the district attorney and public defender to the Post Independent’s motion to unseal the file. Fang argued that the responses should not have been leaked to the newspaper since they were still under the sealed court file.

Fang said she might file a motion to hold the newspaper in contempt. Judge Petre refused to set a possible court date for a possible hearing, saying that his calendar is very full.
