Silt man gets 20 years in sexual assault case

GLENWOOD SPRINGS, Colorado – A Silt man was sentenced to 20 years in prison on Thursday after a jury found him guilty of sexually assaulting two underage victims more than a decade ago.

Martin Delgado-Dominguez, 43, was arrested in August 2007 by Silt Police. An arrest warrant was obtained after multiple alleged victims, who were minors, claimed that they had been assaulted by Delgado-Dominguez. He was convicted in late 2009 on two counts of sexual assault on a child by a person in a position of trust, pattern of abuse, and one count of attempted sexual assault on a child.

Prosecutor Matt Barrett argued for a sentence of 29 years in the Colorado Department of Corrections saying, “[Delgado-Dominguez] has shown no desire to take any responsibility for his actions.”

“The damaged caused by the defendant warrants a significant penalty that sends a message to the community that you will not be given a second chance if you commit the type of crimes that the defendant has been convicted of,” Barrett said.

Defense attorney Greg Greer argued for a much less severe sentence but said that the court was limited in its discretion regarding sentencing.

“A twenty-year sentence serves every legitimate need of criminal justice,” Greer said.

According to Judge Lynch, a mandatory 10-year sentence for each of the sexual assault counts was set by state statute.

Lynch agreed with Barrett that Delgado-Dominguez has taken no responsibility for his actions, and that he has maintained his innocence throughout the ordeal.

“I don’t think that there is any question that [the victims] suffered significant emotional distress,” Lynch said.

She sentenced Delgado-Dominguez to 20 years in the Colorado Department of Corrections for the two felony counts of sexual assault on a child by a person in position of trust, pattern of abuse. He also received three years for the attempted sexual assault charge. That sentence was to run concurrently with the other sentence.

Delgado-Dominguez has 120 days to appeal the guilty verdict and the sentencing if he so chooses.
