Letter: Salazar’s ‘regulatory scheme’ is unconstitutional

Pursuant to Mr. Jim Markuson’s eloquent and well-researched Nov. 15 “Guest Opinion” in the Post Independent on Obamacare [health insurance] zones; obviously Colorado Insurance Commissioner Salazar’s “regulatory scheme” is unconstitutional under the 14th Amendment “equal protection under the laws,” as the zoning of Garfield County is based upon flawed socioeconomic science and is discriminatory to all Garfield County residents. This fact should be a no-brainer for county commissioners Mike Samson, John Martin and Tom Jankovsky and Garfield County Attorney Frank Hutfless.

It also is a no-brainer that Garfield County should immediately challenge the constitutionality of Salazar’s regulatory scheme in court. Of course, that would depend on the county attorney actually having the legal skills to develop a “complaint” and then argue the case in open court on behalf of Garfield County residents.
