An eviction in the spring led to stalking charges in the fall when the Basalt-area tenant reportedly repeatedly harassed and threatened the head of the company that moved, stored and ultimately sold her possessions.
According to testimony in her arrest affidavit, the 55-year-old was in Eagle County custody on March 10 when the moving company was asked to clear out the home. Deputies reportedly removed 10 firearms and assorted ammunition from the home, but left knives, survival books and a gas mask for the movers to clean up.
According to the Garfield County moving company owner, they agreed, at her son’s request, to store her possessions rather than leave them to be snowed on. Rather than pay her storage bill or even pick the items for free, however, she sued the company. In court, all charges were dismissed and the company was allowed to donate the property.
Two weeks after it was all given away, the owner reportedly began receiving emails from the woman, culminating in a black-and-white photo of a body in an open grave – allegedly that of Las Vegas mobster Anthony Spilotro, who was buried alive in 1986.
“We truly fear that she will attempt to hurt or kill us,” the owner wrote of himself and his family.
A warrant was issued for the woman’s arrest July 22 and she was booked on suspicion of felony stalking and failure to appear.
CDALE MAN FACES 6TH DUI
A one-car accident near New Castle on the night of Sept. 23 led to a sixth charge of driving under the influence for a 50-year-old Carbondale man.
A Colorado State Patrol investigation indicates that the Subaru Outback went off the side of East Elk Creek Road and back twice before finally leaving the road for good, sliding down an embankment and striking a tree.
According to the arrest affidavit, EMTs noticed the odor of alcohol, and law enforcement found several bottles of open and unopened whiskey and beer in the car. At the hospital, the man denied drinking and refused a breath test. After reportedly becoming belligerent, he had to be restrained to the bed and a warrant was issued for a non-consensual blood draw.
He was later arrested on suspicion of felony driving under the influence as well as careless driving and open container.
CONVICTION IN w. glenwood GUNSHOT
In a four-day jury trial this week, Mario Ruiz-Alvarado was convicted on all charges for firing a shot during an altercation in a West Glenwood parking lot last year.
The nearby Dairy Queen was open at the time of the shooting, but no one was injured.
Ruiz-Alvarado, 22, of Glenwood Springs, will be sentenced on two counts of felony menacing, one count of possession of a weapon by a previous offender, one count of violation of bail bond conditions, one count of prohibited use of a weapon, one count of reckless endangerment and one count of theft.
MASSEUR FACES SEX CHARGE
A local masseur is suspended without pay and will face a misdemeanor sex assault charge after a woman told police his massage went over the line.
According to the arrest affidavit, the woman was in town with her husband for their wedding anniversary, and booked a couple’s massage on the evening of Sept. 23. She later described alleged contact to police as “really sexual.”
FOLLOW-UP CAR THEFT
Not content with a summons and a boyfriend behind bars, a 19-year-old New Castle woman allegedly left the police station, stole a car and attempted to drive home drunk.
According to their arrest affidavits, the night began with a report of a group of teens breaking into cars early Sept. 22.
After stopping a pickup for speeding nearby and citing the 16-year-old driver with driving under the influence, officers identified a 19-year-old Basalt man asleep in the back seat as a suspect in the break-ins. He was arrested on suspicion of contributing to the delinquency of a minor and trespass, both felonies, as well as conspiracy to commit a felony and misdemeanor theft. His girlfriend, also in the back seat, was cited for minor in possession.
Two hours later, police pulled over a sedan driving without its lights on and recognized the woman. She blew .027 on a breath test – below the legal limit for someone younger than 21. The car’s owner later told police that no one had permission to drive the car and she considered it stolen.
The woman was arrested on suspicion of felony motor vehicle theft and underage driving under the influence.
PARANOIA, THEN ARREST
What began as a search for a man behaving erratically turned into a felony arrest on the night of Sept. 27.
According to the arrest affidavit, a Silt man called police around 10 p.m. to report that his 31-year-old stepson had been acting paranoid all day – saying people were hiding in the walls to kill him and that the Mafia was outside the window. The stepson finally fled through his bedroom window and drove away.
Shortly after midnight, dispatch received a call from a gas compressing station near Rifle. The employee reported that a man had turned up inside a barbed wire-topped fence saying people were chasing him and tried to take the keys to one of the trucks. Foiled, he fled on foot.
The man’s Jeep was found abandoned nearby.
Police finally caught up with him around 5 a.m., when someone called to report a man jumping into traffic. Dirty, ragged and missing a shoe, he was arrested on suspicion of felony trespass, felony burglary and misdemeanor trespass.
WOMAN ALLEGES SEX ASSAULT
After breaking up an argument on the night of Sept. 16, Carbondale police were called back to the parking lot where the situation had allegedly escalated to sexual assault.
According to the resulting arrest affidavit, the couple involved had been living out of their car. After the initial argument, the girlfriend told police her boyfriend started “pushing himself on her,” and the two fought as she pushed him away.
The 42-year-old boyfriend was arrested on suspicion of felony sex assault and misdemeanor assault, which would be treated as domestic violence for the purposes of sentencing.
TAILGATING LEADS TO ARREST
After releasing a woman on a summons for a hit-and-run fender bender, Glenwood Springs police discovered that she had given a false name and had a warrant for her arrest.
The accident took place on the afternoon of Sept. 27. According to the arrest affidavit, a second woman told police that she had been tailgated along Midland Avenue and rear-ended as she approached the West Glenwood roundabout. A witness took a picture of the driver and her car, and police stopped a red Honda with damage to the hood nearby.
Using a friend’s name and birthdate, the 29-year-old Glenwood Springs woman left the scene before officers could tie her to a previous case. After her true identity was determined, a warrant was issued and she was arrested the next day on suspicion of forgery and criminal impersonation, both felonies, as well as failure to appear, failure to provide proof of insurance, failure to report an accident, driving under restraint and following too closely.
NOT GOING QUIETLY
When several requests to quiet down went unheeded, a Glenwood Springs man called the police on a party next door, but the participants weren’t terribly cooperative with them, either.
Police arrived at the apartment early on the morning of Sept. 30 and found a couple dozen young adults inside. They arrested the first underage drinker they encountered, but told the rest to go home after a report of an altercation outside.
According to testimony in his arrest affidavit, a 20-year-old Colorado Springs man had leapt from the apartment’s balcony and began yelling at and threatening the neighbor who went to check on him. When police arrived ,he reportedly tried to run from the scene despite orders to stop. He was Tased and taken to Valley View Hospital where, the affidavit says, he “never stopped yelling curse words” and pulled down his pants in hall.
He was later arrested on suspicion of felony menacing, obstructing an officer, resisting arrest, harassment and underage possession of alcohol.
