A Garfield County man is facing multiple felony charges after authorities say he shot a woman in the shoulder during a domestic violence incident Saturday night at a home on Vista Drive near Silt.
Lance Darrell Wilburn, 45, was arrested on suspicion of criminal attempt to commit second-degree murder, first-degree assault, prohibited use of a weapon and a domestic violence-related offense, according to an affidavit filed in support of his warrantless arrest.
Garfield County sheriff’s deputies were dispatched March 7 to the home after a reported shooting. According to the affidavit, dispatchers were told a firearm had been discharged and that Wilburn, the reporting party, was armed, intoxicated and refusing to put the gun down.
Dispatchers also reported that Wilburn told a woman to stay away from him and made statements including, “I will shoot you again,” according to the affidavit.
When law enforcement arrived, officers found Wilburn lying in the driveway and a woman standing in the doorway of the residence, the affidavit states. Deputies took Wilburn into custody and found a handgun and a phone on the porch near the front door.
The woman was taken to Valley View Hospital. A deputy reported she had suffered a gunshot wound to her right shoulder that entered the front and exited the back. She also had bite marks, according to the affidavit.
Investigators wrote that the woman told them she and Wilburn had been arguing after returning home and that she wanted him to move out of the house. She said she went to relax in a bedroom by a closet door when Wilburn, who was seated on the bed, presented a firearm and fired in her direction, according to the affidavit.
The woman told investigators the first round went by her and the second struck her in the shoulder, the affidavit states. She said she did not believe Wilburn owned any real firearms and initially thought the weapon was a BB gun.
Investigators later executed a search warrant at the residence and recovered a Walther P22CA semiautomatic handgun chambered in .22 caliber on the patio outside the front door, according to the affidavit. The gun was loaded with one round in the chamber and six rounds in the magazine. Investigators also reported finding apparent bullet damage in a bedroom closet trim and on a sweatshirt.
Deputies noted signs of intoxication while taking Wilburn into custody, writing in the affidavit that his breath smelled heavily of alcohol and his speech was slurred.
The affidavit states Wilburn admitted during a recorded 911 call that he had been drinking and had shot the woman. Investigators also wrote that during an interview, Wilburn said, “I was forced to defend myself” and, “After fair warning, I was forced to defend myself.”
Authorities wrote that Wilburn did not report any injuries from an assault and that the woman told deputies there had been no physical disturbance before the shooting, only a verbal argument.
The affidavit also states Wilburn and the woman had a previous intimate relationship and that law enforcement had responded to numerous domestic violence incidents involving the pair. A mandatory protection order was already in place between them, according to investigators, though it had been modified to allow contact.
Wilburn was booked into the Garfield County Jail and is being held on a $75,000 bond. He is scheduled to appear in court on Thursday.
